These Terms of Service ("Terms") govern your use of SerenKind ("Platform," "we," "us," or "our"). By accessing or using SerenKind, you agree to be bound by these Terms. If you do not agree, do not use the Platform.
1. Acceptance of Terms
By using SerenKind, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. We reserve the right to modify these Terms at any time. Your continued use after modifications constitutes acceptance of the updated Terms. We will notify you of material changes via email or on our Platform.
2. Eligibility & Account Registration
SerenKind is available to users 13 years and older. By registering, you represent that:
- •You are 13+ years old (parental consent required if under 18)
- •You provide accurate, complete information
- •You will not impersonate others or create duplicate accounts
- •Your account is for personal use only
You are responsible for maintaining the confidentiality of your login credentials. We are not liable for unauthorized account access resulting from your negligence.
3. Use License & Restrictions
We grant you a limited, non-exclusive, non-transferable license to use SerenKind for personal, non-commercial purposes. You agree NOT to:
- ✗Reproduce, distribute, or transmit content without permission
- ✗Attempt to access unauthorized areas or defeat security measures
- ✗Harass, threaten, or abuse other users
- ✗Engage in spam, phishing, or malicious activities
- ✗Use automated bots or scraping tools
- ✗Violate any laws or third-party rights
Violations may result in account suspension or termination without notice.
4. Medical Disclaimer ⚠️
IMPORTANT: SerenKind is NOT a replacement for professional mental health treatment.

5. Intellectual Property Rights
SerenKind and its content (text, graphics, logos, images, software) are owned by or licensed to us. You may not reproduce, modify, or distribute our content without written permission.
Your conversations and personal data remain your property. You grant us a license to use this data to improve our services, train our AI, and comply with legal obligations (always anonymized unless required by law).
6. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, SERENKIND AND ITS TEAM ARE NOT LIABLE FOR:
- Indirect, incidental, special, or consequential damages
- Loss of data, profits, or business interruption
- Health outcomes or decisions made based on Platform use
- Third-party actions or platform unavailability
Our total liability is limited to the amount you paid for your subscription in the past 12 months.
7. Your Data & Privacy
Your conversations and messages remain your property. SerenKind uses this data only to:
- Provide personalized support and maintain conversation history
- Comply with legal obligations (e.g., mandatory reporting of safety threats)
- Improve platform reliability, security, and user experience
Important: We do NOT train AI models on your personal conversations. Your data is not used to train our language models or AI without your explicit, separate consent.
In the future, we may offer research and analytics programs (e.g., anonymized wellness trends) with opt-in consent. If we do, we will notify you and require your explicit permission before participating.
8. Subscription & Payment
Free Tier: Limited daily messaging. Premium features require a paid subscription.
Billing: You authorize recurring charges through your app store account (Apple App Store or Google Play Store). You may cancel anytime through your app store settings.
Refunds: Refund policies are governed by your app store (Apple App Store or Google Play Store). Please review their refund policies for eligibility. We support refund requests made through the app stores.
9. Safety & Emergency Response
Your safety is our priority. In cases where you disclose imminent threats to yourself or others, we are legally required to take protective action:

10. Termination

Upon termination, your access ceases immediately, but data retention follows our Privacy Policy.
11. Third-Party Links & Services
SerenKind may contain links to third-party websites or services. We are not responsible for their content, privacy practices, or security. You access them at your own risk. Always review their terms before using.
12. Indemnification
You agree to indemnify and hold harmless SerenKind, its team, and partners from any claims, damages, or losses arising from your use of the Platform or violation of these Terms.
13. Governing Law & Dispute Resolution
These Terms are governed by the laws of California, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration, not litigation.
